These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors access to information provided from multiple outside sources as well as posts provided by other members. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

ThinkPatriot.com does not warrant the validity of any information posted on this site as it is an opinion based website. Conspiracies, satire, and news will be available to access on this website and it is the responsibility of the individual user to determine which category the content you see falls into. We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. We want people to use ThinkPatriot.com to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. We can remove or restrict access to content that is in violation of these provisions. If we remove content that you have shared in violation of our Terms, we’ll let you know and explain any options you have to request another review, unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies. We also can remove or restrict access to your content, services or information if we determine that doing so is reasonably necessary to avoid or mitigate legal impacts.

  1. When you delete content, it’s no longer visible to other users, however it may continue to exist elsewhere on our systems where:

    • immediate deletion is not possible due to technical limitations;

    • your content has been used by others and they have not deleted it in which case it will remain until that content is deleted; or

    • where immediate deletion would restrict our ability to:

      • investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate misuse of our Products or systems);

      • comply with a legal obligation, such as the preservation of evidence; or

      • comply with a request of a judicial or administrative authority, law enforcement or a government agency;

  2. in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis).

If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies we may suspend or permanently disable access to your account. We may also suspend or disable your account if you repeatedly infringe other people’s intellectual property rights or where we are required to do so for legal reasons.

At ThinkPatriot.com we will do our best to moderate the comments. As the number of members grow we will need more time to moderate and more resources to do it in a timely manner. If any material on this website violates these Terms or laws, yet remains on the website, you are responsible for reporting the posts and restricting yourself from the content until it can be removed by our moderators. If you find the content offends, disturbs, or violates any laws than you are required by these Terms to report it and not hold ThinkPatriot.com liable for your continued use of the content.

If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place:1,2,3

 

1. Our Products are provided "as is," and we make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content). We cannot predict when issues might arise with our Products. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or  Products, even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to these Terms or Products will not exceed the greater of $100 or the amount you have paid us in the past twelve months.

2. We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it's useful to know up front where it can be resolved and what laws will apply. For any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms or Products ("claim"), you agree that it will be resolved exclusively in the District Court, 1st Judicial District, Laramie County Wyoming or a state court located in Wyoming. You also agree to submit to the personal jurisdiction of either of these courts for the purpose of litigating any such claim, and that the laws of the State of Wyoming will govern these Terms and any claim, without regard to conflict of law provisions.

3. If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by the website owner. 

You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life). Ex: If you claim to be someone you are not such as Donald Trump or Joseph Biden.
